BEFORE OPTING-IN TO RECEIVE PROMOTIONAL/MARKETING EMAILS FROM THE BREWERY, YOU ARE STRONGLY ADVISED TO CAREFULLY REVIEW DIAGEO’S PRIVACY & COOKIE NOTICE. REDEMPTION OF THE OFFER CONSTITUTES YOUR EXPRESS WRITTEN CONSENT TO RECEIVE PROMOTIONAL/MARKETING EMAILS FROM GUINNESS BREWING COMPANY. YOU MAY OPT-OUT OF RECEIVING SUCH EMAILS AT ANY TIME.

Glasses are available while supplies last. Supplies of some types of glasses may be exhausted before others and you may not receive your preferred choice of glassware. Guinness Brewing Company disclaims liability under any legal theory if supplies of any type of glassware are exhausted prior to close of business on July 31, 2019.

Employees, officers, directors and agents of Guinness Brewing Company, its parent company, affiliates, subsidiaries, divisions, and advertising and promotion agencies as well as entities which hold an alcohol beverage retail license in any U.S. state (or Washington, DC) are not eligible for the Offer.

By participating in Offer, consumer agrees to fully comply with these Terms and the decisions of Guinness Brewing Company regarding the Offer, which are final and binding in all respects.

A. RESTRICTIONS ON REDEMPTION

Redemption request is subject to verification by Guinness Brewing Company. Should Guinness Brewing Company determine in its sole discretion that consumer has not fully complied with Offer requirements and/or these Terms, glass will be withheld and Guinness Brewing Company will have no liability to consumer under any legal theory; this includes invalid receipt/proof of purchase or determination that consumer has not opted-in to receive promotional/marketing emails from the Brewery. Violation of Offer requirements and/or these Terms may also constitute fraud; and, in such instance, Guinness Brewing Company may seek any and all available legal remedies so as to protect its rights (in addition to withholding glass from consumer).

Limit of (1) redemption request for (1) glass per person. Consumer must physically take possession of glass at time of redemption. Glasses will NOT be stored for consumers or shipped to them.

Redemption requests by groups, businesses or organizations will not be honored. This Offer is not to be combined with any other Guinness Brewing Company discount, coupon, offer or promotion.

Proof of purchase cannot be used for Offer if underlying good/service was returned for a refund, exchanged for another good/service or if purchase transaction was rejected for any reason (including unauthorized activity). In addition, for Tour admission purchase, if Tour participation was terminated by Brewery personnel due to inappropriate consumer behavior, proof of purchase also cannot be used for Offer.

Proof of opting-in for promotional/marketing emails from www.guinnessbrewerybaltimore.com cannot be used for Offer if consumer in question is in violation of the Website Conditions of Use.

Offer rights are not assignable/transferable. Proof of purchase and opting-in for promotional/marketing emails from the Brewery’s official website are valid only for the original, intended recipient of same and are void if transferred to another person; purchased/sold; traded/exchanged; copied/reproduced; or obtained via unauthorized/illegitimate means.

B. LIMITATIONS ON LIABILITY

Content of custom engraving is subject to approval of Guinness Brewing Company in its sole and absolute discretion. Without limiting the foregoing, Guinness Brewing Company expressly prohibits any content that is profane, obscene, hateful, offensive, of appeal to persons under the legal drinking age, promotes irresponsible or underage alcohol consumption or is unfit for publication.

Actual glass may differ from items on display at Brewery or in Offer advertising, with Guinness Brewing Company disclaiming any and all liability in conjunction therewith.

Once glass has been furnished to consumer, consumer bears sole responsibility for same. Lost, broken or stolen glasses will not be replaced; defective glasses may be replaced by Guinness Brewing Company in its sole and absolute discretion (provided supplies last) contingent upon consumer supplying adequate proof of purchase and proof of opting-in to promotional/marketing emails from Brewery’s official website.

Guinness Brewing Company assumes no responsibility for any computer, telephone, cable, network, electronic, programming or wireless Internet hardware or software malfunctions, failures or errors of any kind. If circumstances beyond its control (such as a strike, riot, civil commotion, governmental action, natural cataclysm, equipment failure/malfunction/error, fraud or tampering/unauthorized intervention) interfere with or prevent altogether Guinness Brewing Company’s implementation of the Offer as originally intended (as determined by Guinness Brewing Company in its sole and absolute discretion), Guinness Brewing Company may in its sole and absolute discretion, modify, suspend or terminate the Offer, including ceasing to honor redemption requests, without liability of any kind; and, in such event, notice of such action will be posted at the Brewery and www.guinnessbrewerybaltimore.com.

By participating in Offer, consumer releases, discharges, indemnifies and holds harmless Guinness Brewing Company, its parent company, affiliates, subsidiaries, divisions, and advertising and promotion agencies, as well as their respective officers, directors, employees, representatives and agents of each of the foregoing, from and against any and all claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from the Offer, including submission of redemption request or acceptance, possession or use/misuse of any glass.

GUINNESS BREWING COMPANY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, INCLUDING THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR THE INTENDED PURPOSE, AS TO ANY GLASS.
